These Terms of Service govern your use of the Bicheno Delivery Pty Ltd (“Bicheno Delivery”) website, including any online ordering. References to 'website' include www.bichenodelivery.com.au. Your use of the Bicheno Delivery website constitutes your acceptance of these Terms of Service.

Subject to law, Bicheno Delivery may, in its discretion, from time to time amend or otherwise modify the Terms of Service. Bicheno Delivery recommends you carefully read, each time you visit the website, the Terms of Service as they may affect your rights.

We respectfully advise that Bicheno Delivery has a zero tolerance approach to all forms of abuse, violence, harassment and hostility, including in person and via written and telephone communications.

If you do not agree with the Terms of Service, do not use the website or order online on the website.

THE WEBSITE

These Terms of Service apply to all users of the Bicheno Delivery website. The Bicheno Delivery website may include content, information, or links to third parties or third-party websites. By accepting these Terms of Service you agree to hold harmless and relieve Bicheno Delivery from any liability whatsoever arising from your use of information from a third party or your use of any third-party website.

Bicheno Delivery recommends that before you disclose any personal information to a third party that you first read and accept the third party's privacy policy and terms and conditions of use (if applicable) of their website.

YOUR ACCESS TO THE WEBSITE

Bicheno Delivery hereby provides its permission for you to access its website in accordance with these Terms of Service, provided that (1) your use of the website is solely for your individual, personal, commercial and non-commercial use, and (2) you will not copy, distribute or publish any part of the website other than as may be reasonably necessary to use the website for its intended purpose, and (3) you will otherwise comply with the Terms of Service.

You agree not to use or launch, or cause to be used or launched, any automated system or program in connection with the Bicheno Delivery website, including without limitation, publishing or distributing vouchers or codes, "robots", "spiders", "offline readers" and the like. Notwithstanding the foregoing, Bicheno Delivery grants the operators of public search engines permission to use spiders to copy materials from the website for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. Bicheno Delivery reserves the right to revoke these exceptions either generally or in specific cases.

You agree not to collect or harvest any personally identifiable information from the website or use the communication systems provided by the website for any commercial solicitation purposes. You agree not to solicit for any reason whatsoever any users of the website with respect to their submissions to the website.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

PRICES AND PAYMENTS

You agree to pay for all products and services you order. Prices given on product pages exclude taxes and shipping. The price of products and services we offer may change without notice from time to time, but we will never change the price of anything you have already ordered and paid for. All prices are quoted in Australian dollars. We accept payment by American Express, Google Pay, Apply Pay, Visa, Mastercard, Union Pay and Shop Pay.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). REFUNDS

If you did not love your delivery, then please let us know. We select, pack and deliver our goods with the utmost care and attention, and only work with the best and most reliable suppliers in Australia. Every delivery is hand selected and checked for expiry or best before conditions (as applicable) and all products are checked for tampering.

Please be careful in providing Bicheno Delivery with correct, complete and up to date address information. If you provide us with an incorrect or incomplete address and we deliver or send via postal shipping, your order as per your instructions, we can accept no responsibility for the mistake. If we are unable to deliver to a provided incorrect or incomplete address and the order is returned to Bicheno Delivery your order will be forfeit and no refund will be provided.

ONLINE ORDERING VIA THE WEBSITE

If the website, application or an electronic device is used (including for online ordering), you are responsible for maintaining the confidentiality of your personal details, password (if applicable) and payment details.

You agree to accept full responsibility for all your activities on our website. You also acknowledge full responsibility for your use of online ordering. You further acknowledge that you are fully responsible for the activities of any individual who accesses our website or applications (including for online ordering), using an electronic device which remains logged in to, or associated with, you. If you order online, we may send you an email or SMS confirming the details of your order. The confirmation will constitute a tax invoice. The online ordering system of our website must only be used by persons over the age of eighteen (18) years, or otherwise under the supervision of an adult or guardian.

By agreeing to the Terms of Service, you are agreeing to be present at the nominated local delivery address at the nominated delivery time, unless you have indicated permission for Bicheno Delivery to leave your bag at the nominated address (“leave bag”) or your order is for postal shipping. 

Bicheno Delivery reserves the right to refuse service, terminate your access to the website or online ordering, remove or edit any content or cancel your order/s in its sole discretion and without prior notice to you.

SHIPPING

We use Australia Post for all Australian orders. You will be notified immediately by email when your package is dispatched, which will include an Australia Post tracking number.

Our shipping costs, standard and express, for all customers Australia wide are aligned with Australia Post and the shipping rates are based on the weights of the products and box size used and the overall rate is determined automatically by a calculator at checkout.

Our aim is to pack and ship your order within 24 hours. However due to the range of products there could be a slight delay if the product is not in stock.

We can restock in a few days and these situations delivery may take up to 6-8 working days from receipt of your order, however we do not guarantee we can deliver in this time frame.

If your order does not meet the requirements for a Free Shipping promotion, then the options for shipping (including relevant prices) will appear when you add shipping details at the cart or checkout.

Please note that Bicheno Delivery is not responsible for any deliveries that may be affected by customs, natural occurrences, transfers from Australia Post to the local carrier, air and ground transportation strikes or delays, nor any extra fees.

Bicheno Delivery reserves the right to change shipping policies and pricing at any time without notification.

Please note that any "Free Standard Shipping" offers over a certain dollar amount does not include bulk orders.

LIMITED TIME OFFERS

Bicheno Delivery may, from time to time, run promotions through its online ordering system which may offer customers an opportunity to redeem a free or discounted item if their order is completed within a certain time frame (a Limited Time Offer).

DISCOUNT VOUCHERS/CARDS

Bicheno Delivery may provide cards offering customer discounts to a certain percentage on their next order. These discounts are limited to one per customer per order and cannot be redeemed on bulk orders (only for gift box orders).

Please note that discount vouchers/cards have the following conditions:

  • Limit one discount card per customer and is valid for one time use only.
  • Cannot be combined with any other running coupons, discounts, offers, or promotions, including free shipping offers.
  • Code provided on the physical Thank You card must be entered at checkout.
  • Offer valid on in stock items only.
  • Offer not valid on previous purchases.

Bicheno Delivery reserves the right to modify or cancel discounts at any time.

GIFT CARD TERMS & CONDITIONS

1. Definitions

  • “Gift Card” means an electronic voucher or code issued by Bicheno Delivery (“we,” “us,” “our”) that can be redeemed for goods or services on our website.
  • “Recipient” means the person who redeems the Gift Card.
  • “Purchaser” means the person who buys the Gift Card.

2. Issue & Redemption

  • Gift Cards may be purchased online via our website.
  • Gift Cards can be redeemed only for goods and services offered on our website.
  • Gift Cards cannot be exchanged for cash.

3. Validity / Expiry

  • Gift Cards purchased from Bicheno Delivery are valid for three (3) years from the date of issue.
  • The expiry date (“ceases to be redeemable”) will be clearly displayed in the email of the Gift Card, and on any printable voucher.
  • If there is no expiry date (i.e. a “no expiry” Gift Card), the voucher/email will contain the statement “No expiry date.”

4. No Post-Supply Fees

  • There are no post-supply fees charged. We do not impose activation fees, balance enquiry fees, inactivity fees, or account-keeping fees.
  • We reserve the right to charge a replacement fee if a Gift Card is lost or stolen, at our discretion.
  • Transaction fees (e.g., credit card processing) may apply at the time of purchase of the Gift Card, but do not reduce the face value once issued.

5. Use of Remaining Balance

  • Gift Cards may be used in multiple transactions until the balance is fully redeemed (unless otherwise stated at the time of purchase).
  • If the remaining balance on the Gift Card is very small and cannot be used “conveniently,” we may, at our discretion, allow a cash payment up to a reasonable amount, OR ask the Purchaser / Recipient to spend down into the balance.

6. Lost or Stolen Gift Cards

  • If a Gift Card is lost, stolen or misused, please email us immediately at email@bichenodelivery.com.au.
  • Replacement of a lost or stolen Gift Card may be offered at our discretion, subject to proof of purchase and original email / order number, and may incur a replacement fee.

7. Cancellation / Refund Policy

  • Gift Cards, once purchased, are non-refundable, except where required by law (for example if there was a manifest error in the purchase).
  • Unused balances on a Gift Card will not be refunded unless required by law.

8. Fraud / Abuse

  • We reserve the right to refuse to redeem any Gift Card that we reasonably suspect has been fraudulently obtained or used.
  • We may cancel or suspend a Gift Card if we believe its use breaches these Terms, or if it is being used for money laundering or other unlawful purposes.

9. Governing Law

  • These Terms are governed by the laws of Tasmania, and the Commonwealth of Australia (including the Australian Consumer Law).
  • If any provision of these Terms is found to be invalid, unenforceable or void, that provision is severed and the remaining terms continue in full force.

10. Changes to Terms

  • We may amend these Terms at any time. Any changes will apply to new Gift Cards issued after the change. We will publish updated terms on our website.
  • If we make significant changes (e.g. reducing the validity period), we may notify existing Gift Card holders by email (if we have their address) to give them reasonable notice.

LIMITATION OF LIABILITY

To the extent permitted by law, Bicheno Delivery’s liability in relation to any product or service purchased as a consequence of your use of this website is limited to the lesser of: (a) the replacement of any product purchased; and (b) the purchase price paid by you to Bicheno Delivery for the product or service.

To the maximum extent permitted by law, we will not be liable to you for any loss or damage (whether direct, indirect or consequential) howsoever caused, nor will we be in default under these Terms of Service, for failure to observe or perform any of our obligations under these Terms of Service for any reason or cause except if caused by our gross negligence. If a jurisdiction does not allow the exclusion or limitation of liability in accordance with this paragraph but allows a limitation of a certain maximum extent then our liability is limited to that extent.

INDEMNITY

You agree to defend, indemnify and hold harmless Bicheno Delivery and related corporations, affiliates, and the officers, directors, employees and agents of these entities, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees) arising from or in connection with: (i) your use of and access to the website (including any online ordering); (ii) your violation of any term of these Terms of Service; and (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right.

ABILITY TO ACCEPT TERMS OF SERVICE OF USE

You affirm that you are either more than 18 years of age, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service.

GENERAL

These Terms of Service shall be governed by the laws of Tasmania, Australia. Any claim or dispute between you and Bicheno Delivery that arises in whole or in part from the Bicheno Delivery website shall be decided exclusively by a court of competent jurisdiction located in Hobart, Tasmania. These Terms of Service, together with any other legal notices published by Bicheno Delivery on the website, shall constitute the entire agreement between you and Bicheno Delivery concerning the website.

If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service as applicable, which shall remain in full force and effect. No waiver of any term of these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and the failure by Bicheno Delivery to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision.
